In the wake of the successful launch of its new Viagra® treatment, the pharmaceutical giant Pfizer, the U. S. Food and Drug Administration, announced it will lose its patent protection after receiving approval from the FDA. In December, Pfizer announced that it had entered into an agreement with the U. pharmaceutical company, Teva Pharmaceutical Industries Ltd., to license its erectile dysfunction drug, Viagra®, from the company. Pfizer will begin marketing the drug through its website, and its website will be available to doctors and pharmacists at pharmacies and health centers throughout the U.
The Pfizer patent protecting Viagra® expires in 2017. Pfizer will be allowed to continue making and marketing Viagra® for the rest of its life, until the patent protection expires.
Pfizer has also filed a lawsuit against the U. Food and Drug Administration to prevent the FDA from issuing its final recommendations about the risks and benefits of Viagra®. The lawsuit alleges that the FDA has not assessed whether Pfizer’s use of the drug will be appropriate under the conditions of the Food and Drug Administration, and that Pfizer knew or should have known about the risks.
In a court filing in New York on January 14, 2017, the FDA said it had determined that Viagra® could be effective for erectile dysfunction and that Pfizer’s marketing efforts were not a sufficient reason to stop using the drug. The FDA, however, stated that it was satisfied that Viagra® is “potent and safe” when evaluated by the FDA. Viagra® was approved by the FDA in 1998 and has been approved since then by numerous countries. The drug’s safety was reviewed by the FDA and is currently under review by the U. Food and Drug Administration.
Pfizer’s lawsuit, filed in New York State Court in the U. S., is based on the allegation that the FDA is in violation of the Food, Drug, and Cosmetic Act, which prohibits any form of “doctor-prescribing” for a condition. Pfizer has denied that claim.
Pfizer also faces a number of lawsuits filed by individuals claiming that the drug was marketed for sexual performance enhancement. According to the lawsuits filed by women who have been injured by the use of Viagra®, they claimed that the drug was “damaging” their reproductive system and that the drug caused them to experience an inability to get or maintain an erection. The lawsuit is based on the allegation that Pfizer had a duty to disclose the risks and benefits of Viagra®. According to the lawsuits, the company knew or should have known that Viagra® was being used for sexual performance enhancement before the FDA approved its use of the drug in 1998. The FDA, however, has found that the company did not properly evaluate the risks and benefits of Viagra®.
In a statement to Bloomberg, Pfizer said that “the U. Food and Drug Administration approved Viagra® in 1998, and it is a safe drug, and it is effective for sexual performance.”
A Pfizer spokesman told Bloomberg, “We are pleased with the FDA’s decision to approve Viagra®. Pfizer’s commitment to the U. public has always been to provide information that helps our patients make informed decisions about their health. We are confident that the FDA will follow its instructions.”
The FDA is conducting a review of Viagra® and will consider its safety, efficacy and the potential risks associated with its use. If the FDA determines that the drug is not appropriate for the treatment of sexual dysfunction, the FDA may issue a warning to the company immediately. The FDA also has authority to order Pfizer to stop the drug’s use.
